PACE Offers Pre-Loss Legal Services

July 21, 2006 - Each PACE member district is entitled to up to $1,000 in legal consultation fees per incident at no cost to the district before a lawsuit is filed as part of PACE’s new pre-loss legal services.

If your district calls for pre-loss legal advice prior to making an employment termination decision, the $5,000 deductible for employee terminations will be waived. Districts will have the option of receiving more than the free $1,000 of legal advice at the reduced member rate of $120 per hour.

Pre-loss legal advice is available in two forms: personal consultation with an attorney about a specific incident or action and seminars that help you and your employees run a lawsuit-free operation.

Pre-loss legal services from PACE cover typical legal actions against education entities, including injuries that occur on school property, claims of employer misconduct, and actions involving discrimination, termination, harassment, retaliation and hostile work environment. Union grievances are not covered.

PACE offers custom on-site pre-loss legal seminars and regional seminars that cover topics of more general interest. You may arrange an on-site seminar at a time convenient to your organization.

Call OSBA, 503-588-2800 or 800-578-6722, and ask for Dori Brattain, OSBA associate executive director, Rebekah Cook, OSBA attorney, or Morgan Smith, OSBA attorney.
