PACE Legal Services

Get advice you can trust before a situation gets out of control. PACE members have access to full-time attorneys who are experienced in dealing with education and employment-related issues. They are able to offer advice, investigation, defense, and audit services.

  • Examples of When to Call a PACE Attorney

    • Personal injury on school property – Whether it’s a student injured at sports practice or a parent injured while attending a school event, our staff can often help avoid a lawsuit.
    • Employee termination – Most PACE deductibles are waived If your district consults with a PACE legal attorney prior to making an employment termination or suspension decision.
    • Student or employee harassment, bullying, discrimination, or retaliation – Call as soon as you receive notice of a complaint. We can assist with investigation and follow-up to minimize liability and resolve the situation.
    • Inappropriate staff/student relationships – Legal staff can assist with investigation; ending the employment relationship; and communicating with the press, the community, criminal attorneys, and law enforcement.

Tenant User Liability Insurance Program

    Schools are often the heart of the community and the largest facility available for group meetings. But liability issues make it tricky for education organizations to allow the use of their facilities for non-school events.

     

    The TULIP program allows community groups and others to buy low-cost special event insurance. Many activities allowed on school grounds are covered.

Despite our best planning, challenges arise daily for Oregon’s school districts, education service districts and community colleges. Sometimes those challenges becometurn into a crisis, requiring fast and accurate communications with your audience.

    Every year, our trained communications professionals assist dozens of school and community college leaders in getting through difficult circumstances – from gun incidents to criminal charges filed against staff members to heartbreaking tragedies such as suicide.

     

    We coordinate with PACE legal staff to ensure that our messages are in keeping with legal requirements.

Risk Management Support

Criminal Background Checks

Among PACE’s many valuable services to its members is the criminal background check program developed with BIO-MED Testing Services.

  • Advantages

    +

    • The safety of students and potential liability from negligent-hiring lawsuits are a strong justification for pre-hire background checks. In Oregon, as in other states, lawsuits for negligent hiring are among the fast-growing areas of tort litigation.
    • Using a national database, PACE members can conduct comprehensive pre-employment criminal history background checks for both job applicants and volunteers. Better yet, the results come back on the same day.
  • Features

    • PACE’s background check scans nationwide information from the following sources:
      • State court repositories
      • State Administrative Office of the Courts
      • Departments of Corrections
      • County court records
      • Traffic court records
      • State sex offender registries
      • Probation, parole, and community service records.
    • PACE pays for the first five background checks in a calendar year for each PACE member. The fee is just $29 per background check after that.

Drug and Alcohol Testing

PACE and BIO-MED Testing Services developed a program to help PACE members maintain a drug-free workplace.

      • Non-DOT testing: $40

  • Free Onsite Risk Management Inspections

    +

    Avoid liability and losses by taking a fresh look at vocational shops, gymnasiums, playgrounds, weight rooms, art and science classrooms, kitchens, and other school facilities. Risk management teams visit facilities to conduct inspections, answer questions and offer training.

SawStop Grant Program

    The SawStop Grant has been approved for another year! 

    SawStop Grant Program is available until grant funds of $50,000 for a SawStop and $20,000 for a SawStop Blade Replacement are exhausted. Application available below.

  • Who Qualifies for the PACE Safety Grant Program?

    PACE members enrolled in the PACE property/casualty risk program are eligible to apply for a grant. Prior approval of the grant application must be obtained before purchase.

  • What Projects will Qualify for the Grants?

    This year’s grant program will focus on replacing table saws in the vocational shop and drama departments. Your entity needs to identify a table saw(s) to be replaced. REMOVAL OF THE OLD SAW(S) FROM SERVICE IS REQUIRED. The SawStop saw will be purchased by your entity and PACE will reimburse your entity based upon the criteria below. PACE has worked with SawStop to offer special discounted pricing for this program.

  • What Dollar Values Will be Awarded for This Year’s Grant Program?

    PACE members will be awarded funds based on these categories:

    • K-12 members with 1-999 ADM — one SawStop with 25% district contribution and 75% PACE Grant
    • K-12 members with 1,000-2,999 ADM — one SawStop with 50% district contribution and 50% PACE Grant
    • K-12 members with 3,000 and more ADM — one to three SawStops with 66% district contribution and 34% PACE Grant
    • Education Service Districts members — one SawStop with 50% ESD contribution and 50% PACE Grant
    • Community college members — one, two or three SawStops with 66% college contribution and 34% PACE Grant
  • PACE SawStop Blade Replacement Grant

    PACE members can apply for funds to help offset the cost of replacing activated blades and cartridges. Fill out the fillable PDF and return to PACE Risk Management. Grants are available to districts on a first-come, first-served basis, until the funds are exhausted.

    As a PACE member, your entity helps control insurance costs by jointly pooling resources with fellow members to self-insure property and liability insurance.  The PACE Risk Management Department’s primary mission is to support your loss control endeavors, thereby reducing both your costs and those to the risk pool in general, while helping to promote the safety and well-being of all stakeholders. The early detection and mitigation of potential risk is crucial to these efforts.

     

    The PACE Risk Management Team has developed on a new toolkit, it will be called the PACE Self-Assessment Tool.  The new Self-Assessment Tool will provide information to the risk team to assist them in targeting their risk management efforts where help is needed.  As PACE members complete the tool in the insurance portal the risk team will track the answers and then follow up with the members that need assistance.

    Each district needs to go to the insurance portal and answer the following questions to receive their 5% General Liability discount:

  • Has a staff member participated in a PACE training?

    The purpose of training is to develop skills, gain awareness of risk and how to mitigate them, knowledge to change behavior, and protect the health and safety of students, patrons, and our buildings. You can accomplish this by completing one or more of the following:

     

    • Attend a PACE Legal or Risk Management training
    • Attend a PACE Legal or Risk Management webinar
    • Attend a school conference that covers Legal and/or Risk topics
  • Has the member completed SAM Prevention responsibilities?

    Sexual Abuse and Molestation (SAM) is a pervasive societal problem. The purpose of this section is to identify the key partners in prevention at your location.

     

    • Identify your Title IX coordinator (Community Colleges only)
    • Identify your Designated License Administrators (K-12 only)
    • Complete required Child Abuse and Sexual Conduct annual training (K-12 only)
    • Do you have a tip line? (ie. SafeOregon)
  • Has the member completed the Cyber Security responsibilities?

    Cyber Security continues to be an emerging threat. All of the following are proactive ways to strengthen your Cyber Security.

     

    • Change passwords annually
    • Restrict administrative rights
    • Back up data daily
    • Staff training on cyber security
    • Implement a Cyber Incident Response plan
  • Has the member completed a property review?

    The PACE Pool has almost $20 billion in total insured value. Property claims continue to be a significant loss indicator and are one of the primary driving costs for the insurance program.

     

    • Site visit from Risk Management in the last three years?
    • Have a process in place to internally conduct routine hazard assessments of all insured properties
    • Regular staff trainings on hazard assessments
    • Did staff attend a conference or other training session related to preventative property maintenance (i.e. OSFMA, OSSOA)
  • Has the member completed the Risk Management Survey?

    The purpose of the survey is to identify the needs of our members. The Risk Management team will use this information to target our safety efforts in the future.
